Terms & Conditions

1. INTERPRETATION AND DEFINITIONS

1.1 In these Terms and Conditions (“Terms”), the following expressions shall have the following meanings unless the context otherwise requires:

“Company” means Lusso Campers Limited (Company No. 14099533), whose registered office is at 20 Clayfield Drive, Bradford, England, BD7 4JA. VAT No. 420619718.

“Customer” means any individual, firm, company or other entity purchasing Goods or Services.

“Goods” means any products supplied by the Company.

“Services” means any labour, installation, fitting or related work carried out by the Company.

“Contract” means any agreement between the Company and the Customer for the supply of Goods and/or Services incorporating these Terms.

1.2 References to statutes include any amendment or re-enactment thereof.

1.3 Headings are for convenience only and shall not affect interpretation.

2. BASIS OF CONTRACT

2.1 These Terms shall apply to all Contracts to the exclusion of any other terms that the Customer seeks to impose.

2.2 The placing of an order shall constitute an offer by the Customer to purchase Goods or Services.

2.3 A Contract shall only come into existence upon written acceptance by the Company or commencement of performance.

2.4 The Customer acknowledges that no reliance has been placed on any representation not expressly set out in these Terms.

3. PRICE AND PAYMENT

3.1 All prices are inclusive of VAT unless otherwise stated.

3.2 Full payment shall be made in cleared funds prior to commencement of any work or dispatch of Goods.

3.3 The Company shall not be obliged to commence performance until payment is received in full.

3.4 All sums paid are non-refundable except where required by law.

4. CONSUMER CONTRACTS REGULATIONS 2013

4.1 Where the Customer is a consumer, they shall have the right to cancel the Contract within 14 days of receipt of Goods.

4.2 The Customer must notify the Company in writing of cancellation.

4.3 Goods must be returned within 14 days of cancellation at the Customer’s cost unless faulty.

4.4 Refunds shall be made within 14 days of receipt of returned Goods.

4.5 This right does not apply to bespoke or personalised Goods.

5. CUSTOM AND BESPOKE GOODS

5.1 Goods made to the Customer’s specification are exempt from cancellation rights.

5.2 Once materials are ordered or work commences, all payments are non-refundable.

5.3 The Customer warrants that all specifications provided are accurate.

6. DELIVERY, RISK AND TITLE

6.1 Delivery dates are estimates only.

6.2 Risk shall pass upon delivery or collection.

6.3 Title shall not pass until full payment has been received in cleared funds.

7. ACCEPTANCE AND INSPECTION

7.1 The Customer shall inspect Goods within 7 days.

7.2 Any defects must be reported within this period.

7.3 Failure to notify shall constitute acceptance.

8. WARRANTY

8.1 The Company provides a 12 month return-to-base warranty.

8.2 The warranty shall be void if unauthorised repairs or modifications are carried out.

8.3 This warranty is in addition to statutory rights.

9. LIMITATION OF LIABILITY

9.1 Nothing shall limit liability for death or personal injury caused by negligence.

9.2 The Company shall not be liable for indirect or consequential losses.

9.3 Liability shall not exceed the amount paid.

10. INSTALLATION LIABILITY

10.1 The Company shall not be liable for pre-existing faults in vehicles.

10.2 Liability is limited to agreed scope of work.

10.3 No liability for consequential loss.

11. EVIDENCE AND RECORDS

11.1 The Company may rely on photographic or recorded evidence in any dispute.

12. GENERAL PROVISIONS

12.1 Entire Agreement: These Terms constitute the entire agreement.

12.2 Severance: If any provision is invalid, remaining provisions shall remain in force.

12.3 Waiver: Failure to enforce any right shall not constitute waiver.

12.4 Third Party Rights: No third party shall have rights under the Contract.

12.5 Variation: No variation shall be binding unless in writing.

13. GOVERNING LAW

13.1 These Terms shall be governed by the laws of England and Wales.

13.2 The courts of England and Wales shall have exclusive jurisdiction.

SCHEDULE 1 – WARRANTY DETAILS

This schedule sets out the scope of the 12 month return-to-base warranty, including exclusions for misuse, third-party alterations, and wear and tear.

SCHEDULE 2 – RETURNS PROCESS

This schedule outlines the process for returns, including notification, approval, packaging requirements, and refund timelines.
